Shanghai Pudong Court on Sept 6, 2019 awarded Punitive damages to a foreign company in the amount of 3 Million RMB (fully supported it's claim).

The court found the defendant, a Chinese company repeatedly infringed the foreign company's trademark right. The Chinese company refused to provide it's sales data for calculation of damages. The court then used it's promotion materials on social media and calculates it's illegal gain which amounts to over 1 Million RMB. The court decided that triple damages apply in this case due to repeated infringement. Therefore, the court fully supported the foreign party's claim of 3 Million RMB.
