
Under Armour won a trademark infringement and unfair competition case at the Supreme People's Court (SPC) of China, against Fujian Tingfeilong Sports Goods Company. On March 10, 2020, the SPC made a final ruling that Tingfeilong's use of the sign "Uncle Martian" constituted trademark infringement of "Under Armour" trademark right. The SPC also found that the VP sales of Tingfeilong used Under Armour (China) on his business card constituted unfair competition.
This final ruling confirmed the first instance ruling made by Fujian High People's Court in terms of finding the trademark infringement and unfair competition and also in terms of the amount of damages. A total damage of RMB 2 million (US$285,700) was awarded in this case, including reasonable expenses of Under Armour for stopping the infringement among which RMB600,000 (US$85,700) was the attorney fee.
